Terms of Service

These Terms of Service ("Terms") are an agreement between you and John 812 LLC ("BlueMarble," "we," "us," or "our") governing your use of ARE Prep, our web service for preparing for the Architect Registration Examination (the "Service"). Please read them carefully.

1. Acceptance of these Terms

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Service, you represent that you meet these requirements.

3. Your account and responsibilities

• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.
• You may sign in using an email and password, a sign-in link we email you, or Google where offered. You agree not to share your account or let others use it.
• One person, one account, unless we agree otherwise.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Copy, scrape, resell, or redistribute questions, explanations, concept cards, or other content from the Service, except for your own personal study;
• Attempt to access accounts, data, or systems that are not yours, or probe, scan, or test the vulnerability of the Service;
• Interfere with or disrupt the Service, including by overloading, injecting malware, or bypassing rate limits or security controls;
• Reverse engineer or attempt to extract source code except to the extent this restriction is prohibited by law;
• Use automated means to access the Service in a way that harms it or other users.

5. Intellectual property

The Service and its content, including practice questions, explanations, walk-throughs, concept cards, software, text, graphics, and the BlueMarble name and logo, are owned by BlueMarble or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own exam preparation. All rights not expressly granted are reserved.

Any data you enter remains yours; you grant us the limited rights needed to store and process it to provide the Service, as described in our Privacy Policy.

6. Disclaimers

No pass guarantee. ARE Prep is a practice tool. We do not guarantee that you will pass any division of the Architect Registration Examination, obtain licensure, or achieve any other outcome. Readiness estimates, mastery figures and study recommendations are approximations for study purposes only and are not official results. The Service is written to reflect the publicly available ARE 5.0 Guidelines and standard professional-practice references, but it is not an official NCARB product and exam content may differ.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any content is accurate or complete.

7. Limitation of liability

To the maximum extent permitted by law, BlueMarble and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the service. To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim or fifty U.S. dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Termination

You may stop using the Service and delete your account at any time from the Progress screen. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will survive.

9. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules, and you and BlueMarble agree to the exclusive jurisdiction of the courts located there for any dispute not subject to another agreed process.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take additional steps to notify you where appropriate. Your continued use of the Service after an update means you accept the revised Terms.
